I bet Louisiana’s 4th District always beams with pride when they see that their tax dollars are spent wisely on the salary of US Congressman and John C. Fleming, M.D. I am amazed at the care and timeliness of his reports back to his constituents. As always he has a perspective that can not be ignored on the Obamascare/Obamacare/Health Scare/Health Care legislation. America he’s looking out for all of us, not just his district!

Congressman Fleming Introduces Legislation to Handicap Implementation of New Health Care Reform Law

As you may have heard, the House voted to repeal the new health care reform law, but the Senate failed to do so this week by a vote of 47-51.  So, as a recent article in The New England Journal of Medicine pointed out, a step in the right direction is to choke off funding for the new law.

For this reason, I have introduced H.R. 38 to rescind the Health Insurance Reform Implementation Fund, a $1 billion fund appropriated as part of the Reconciliation package to pay for federal administrative expenses at the IRS and the Department of Health and Human Services to carry out the Patient Protection and Affordable Care Act together with the Health Care and Education Reconciliation Act of 2010.

WHAT THIS MEANS FOR YOU:  As of the end of November 2010, $40.8 million of these funds have been obligated to provide for administrative expenses of the Health and Human Services and the IRS to implement the new health care reform law.  By rescinding this fund, $900 million would be returned to the treasury, thereby reducing the federal deficit.

While this represents only a small fraction of the astronomical cost of the new health care law, it would have a substantial affect on implementation as it removes the funding source for administrative expenses in carrying out the laws.

THE DOCTOR’S DIAGNOSIS:  When government-administered health care reform passed Congress last year, the Democrat majority together with the President, raised all sorts of claims like: it would lower insurance premiums, increase health care access and lower costs.  Contrary to these claims, as this law continues to be implemented, insurance premiums continue to rise, health care insurance companies are offering fewer options, some companies will no longer offer insurance, and Medicaid and Medicare are facing significant physician shortages.  The American people have spoken clearly that they do not want government-administered health care.  It’s time to stop implementing this new health care law and choke it off at the roots.  That is why I have introduced H.R. 38, to handicap implementation of this devastating law.

I remain committed to continue to work aggressively in Congress to repeal what I firmly believe to be an onerous and unconstitutional health care reform law and support market-based solutions to our health care needs.

Taxing Over-the-Counter Medications

Under the new health care reform law, over-the-counter drugs cannot be reimbursed tax-free from Health Savings Accounts (HSAs) or Flexible Spending Accounts (FSAs) without a prescription beginning January 1, 2011.

Special Interest Group for IIAS Standards (SIGIS) released a list of the more than 15,000 over-the-counter medications that will soon require a prescription for a tax-free withdrawal from an HSA or an FSA under the new health care reform law:

  • Acid Controllers
  • Allergy and Sinus medicine
  • Antibiotics
  • Anti-Gas Products
  • Anti-Itch and Insect Bite
  • Baby Rash Ointments/Creams
  • Cold Sore Remedies
  • Cough, Cold, and Flu
  • Digestive Aids
  • Pain Relievers
  • Respiratory Treatments
  • Stomach Remedies

WHAT THIS MEANS FOR YOU:  As of May 2010, approximately 10 million Americans were covered under HSA plans for their family’s health care needs.   The Joint Committee on Taxation estimates that this provision of the new health care law will cost American families $5 billion.

THE DOCTOR’S DIAGNOSIS:  Americans need more affordable access to health care, not higher taxes on over-the-counter medication.  For this reason, I have introduced H.R. 5126, the “Helping Save Americans’ Health Care Choices Act,” which will roll back these taxes on over-the-counter medications and ensure that affordable choices will remain available to Americans.

I firmly believe that high-deductible plans associated with HSA’s are a key option for providing affordable health care.  As an article published in the Wall Street Journal earlier this spring put it:   “To a large extent, increased health care spending is a consequence [the fact that] neither the patient, the doctor, the insurance company, nor any government program has incentive to spend health care dollars efficiently.”  High deductable plans associated with HSAs create exactly those incentives, giving families ownership over their health care spending so that they can be careful and informed shoppers.

I will continue to work to repeal what I firmly believe to be an onerous and unconstitutional health care reform law which passed last March and find market-based solutions to our health care needs.

The Administration Spent $20 Million of Taxpayer Money to Mislead American Seniors on the New Health Care Reform Law

Earlier this month, the Government Accountability Office (GAO) (an independent and nonpartisan investigative arm of Congress) issued a report finding that the Administration’s Medicare mailer, which cost American taxpayers almost $20 million, inaccurately claimed that the new health care law would not negatively impact seniors’ benefits.  Specifically, the GAO found that “[T]he brochure overstates some of [health care reforms’] benefits” (emphasis added).

For example, the mailer promises seniors that the new health care reform “will provide you and your family greater savings and increased quality health care.”

Instead, the GAO found:

  • In our view, the brochure presents a picture of [the new reform law] that is not universally shared.  For example, two government analyses have determined that [the health care reform law] reductions in funding for Medicare Advantage may decrease enrollment and result in less generous benefit packages,” and “…significant increases in premiums for some beneficiaries may be necessary” [emphasis added].

The GAO found other, similar promises equally questionable:

  • “The brochure does not provide beneficiaries with a comprehensive summary of changes to Medicare that will be implemented as a result of [the health care reform], and in several instances it provides abbreviated information that leaves out details about [the health care reform].” [emphasis added]
  • “We noticed, also, that the brochure overstates some of [the reform law’s] benefits. For example, it states [it] “increases the number of primary care doctors, nurses, and physician assistants,” when [the health care reform law], in fact, only provides incentives for such increases.”

WHAT YOU SHOULD KNOW: After having spent nearly $20 million of your tax dollars on this mailing, seniors continue to view the law negatively, and I couldn’t agree more.  The administration’s assertions fly in the face of the analysis done by the nonpartisan Congressional Budget Office and the Medicare Actuaries which have both documented that the law will cut Medicare by over one-half trillion dollars, cause millions of Americans to lose the plan they have and like, jeopardize seniors’ access to health care and increase the shortage of physicians.

THE DOCTOR’S DIAGNOSIS: American seniors have been asked to pay for a huge chunk of Obamacare.  From raiding the social security trust fund to cutting Medicare by one-half trillion dollars, this administration and the liberal majority in Congress have done little to protect seniors or our economy.  It’s time for new leadership in Washington.

As this process unfolds, I will continue to work to repeal what I firmly believe to be an onerous and unconstitutional health care reform law which passed last March and find market-based solutions to our health care needs.

OPINION

What took 5 1/2 days to cap this pipe? It was not miles off shore, nor was it deep under the water. Why did the event happen in the first place? From the initial article above:

“…The Coast Guard said the towboat Pere Ana C was pushing the barge on Mud Lake when it hit the wellhead about 1 a.m. No one was hurt.

The towboat captain told investigators the well was not lit as required, Coast Guard Capt. John Arenstam said…”

Why at that time, in the wee hours of the morning, was a barge and towboat moving on the waters, and what the heck is the captain talking about ‘not lit’? Where were HIS lights? Where were his charts? Where was his fathometer? Where were his brains?

Does not make sense unless…

IT’S BAAAAAACK – The Public Option is Being Considered in Congress Again

If you thought the worst of the health care debate was behind us, think again.  Earlier this week, 128 liberal Democrats joined California Democrat, Lynn Woolsey on a new bill, H.R. 5808, that would amend the new health care reform bill to create a public option in the new health insurance exchanges.  While there are a few minor changes in this new bill, this public-option model is nearly identical to the original government health care plan we fought so hard against and defeated just 6 months ago.

WHAT YOU SHOULD KNOW: This new public option is being presented by Woolsey and her liberal colleagues under the ruse of reducing the deficit.  That’s right—they want to grow the public welfare state and have you think it will reduce government spending.  Can you say, ludicrous?  This ploy of theirs won’t stop as long as Nancy Pelosi is Speaker.

THE DOCTOR’S DIAGNOSIS: America must continue to provide the best health care services while providing affordable access to that care.  Although still in its infancy, we are already seeing some of the devastating impacts of the new health care reform law.  Companies are already making plans to lay off employees and some businesses are closing as a direct result of that legislation.  If the current Majority moves our country further toward a public option, we will end up with a health care system like the NHS, which we know subjects British citizens to long lines, rationing and preventable deaths.

Early in this debate, in response to the insistence by many in the majority that health reform contain a public option, I offered a resolution, H. Res. 615, to require Members of Congress to put their money where their mouth is, and urge colleagues who vote for legislation creating a government-run health care plan to lead by example and enroll themselves in the same public plan. Nearly 4 million Americans from all 50 states contacted my office to offer their support for H. Res 615.

As this process unfolds, I will continue to work to repeal what I firmly believe to be an onerous and unconstitutional health care reform law which passed last March and find market-based solutions to our health care needs.

Lt. Michael C. Behenna and the Clemency Board

To All Michael Behenna supporters,

*[We travel to Washington D.C. this week to plead Michael’s case before the Army Clemency Board. We have so much to tell them, but we are given only ten minutes to convey our many thoughts. Amazingly, Michael’s sentence of 20 years is twice what any other soldier has been sentenced for unpremeditated murder. It is our hope that the Clemency Board will at the very least bring Michael’s sentence into line with others. Even better would be if the Board decided to release him pending his appeal.

Michael’s attorney’s filed his appeal on 12/22/09 and their appellate brief gives us great hope the appellate court will need to look long and hard as to whether Michael received a fair trial. Special focus was put on the prosecution withholding crucial evidence offered by their own expert which could have exonerated Michael on the murder charge.

Your support of Michael during this holiday season has been emotionally and spiritually uplifting. Our son received hundreds of cards that helped him get through this difficult time. Please keep him in your thoughts and prayers in the coming weeks and keep up your letter writing to the Secretary of the Army, Honorable John McHugh, 1400 Defense Pentagon, Washington, DC 20301-1400. In the end we believe that Michael will prevail.

Of special note is that Michael’s case was selected as #5 in the top ten articles covered by the Court of Appeals of the Armed Forces (CAAF) Blog. The fact that persons covering military appeals have shown such an interest in Michael’s case helps provide encouragement for those of us that feel Michael’s case is so much more than another war related murder case.

CLEMENCY BOARD TO HEAR ADDRESS

WASHINGTON — Vicki Behenna has 10 minutes to plead her son’s case.

Where does she begin?

In the last few months, she has developed hours of arguments about why U.S. Army 1st Lt. Michael Behenna was wrongly convicted of killing a suspected terrorist in Iraq in 2008, why his 20-year sentence for unpremeditated murder was too severe compared to other sentences for the same offense and why the military rules for detaining suspected terrorists make no sense in a combat zone.

She will have to condense all that into a matter of minutes when she appears Thursday before the Army Clemency and Parole Board in Arlington, Va.

Vicki Behenna, of Edmond, is a federal prosecutor — she was part of the team that won conviction of Oklahoma City bomber Timothy McVeigh — so she knows something about making concise and cogent arguments in a legal setting. When she appears before the clemency board, though, it will be “as his mom,” she said last week.

She said she has been given 10 minutes to address the board and that she will focus primarily on the length of her son’s sentence for unpremeditated murder. Though she hasn’t been able to find a central data bank of courtmartial sentences, she said the longest other recent sentence she could find for unpremeditated murder in a combat zone was 11 years. Her son originally received a 25-year sentence, which was reduced to 20 years. Michael Behenna, who is 26, is serving that sentence at Fort Leavenworth, Kan.

The clemency hearing is just one of the legal routes being pursued by Behenna and her husband, Scott.

Houston attorney Jack Zimmerman recently filed an appeal claiming Michael Behenna’s conviction should be overturned, in part because prosecutors didn’t turn over evidence that would have corroborated Behenna’s story that he shot the victim in self-defense. The evidence was the opinion of a renowned expert on bloodstains.

The Behennas have also enlisted Oklahoma attorneys and elected officials to write letters to military leaders and the clemency board urging that Lt. Behenna’s case be handled fairly and according to legal principles.

The Behennas plan to be on Capitol Hill this week telling Michael’s story. Though Congress is still in recess, the Behennas are hoping to meet with staff members of lawmakers who sit on the Armed Services committees.

Vicki Behenna said congressional panels need to hold hearings on the rules regarding detaining suspected terrorists. Currently, she said, the rules require a suspect to be released unless stringent conditions are met.

Military officials decided those conditions were not met for Ali Mansur Mohamed after Behenna captured him in Iraq with evidence that he had ties to al-Qaida.

Behenna suspected that Ali Mansur had been involved in planting a roadside bomb that killed two members of his platoon and wounded others.

Behenna had arrested Ali Mansur at his home, and Behenna was the one ordered to take Ali Mansur back home when he was released from custody.

Behenna shot and killed Ali Mansur that night after questioning him. Prosecutors said it was an execution; Behenna claimed Ali Mansur had been trying to grab Behenna’s gun.

The case has received national media attention and has been taken up as a cause on some Web sites, including one started by the Behennas called DefendMichael.com; a petition posted on the site seeking a new trial for Lt. Behenna has more than 6,500 signatures.

Bev Perlson, whose son has served four tours in Iraq and Afghanistan and who started a group called Band of Mothers, accompanied Vicki Behenna to lawmakers’ offices on Capitol Hill in early December. Perlson features Lt. Behenna’s case promi nently on her Web site and said in an interview last week that she is encouraging veterans and others to show up at the hearing on Thursday.

Though the public is not allowed into the hearing, Perlson said it would be an important show of support just to have people outside the building.

“It just breaks my heart what happened to Michael,” she said.]
